This website provides general information about Boochy Tech, its services and its software products. Website copy is not a project proposal or a guarantee that a particular feature, delivery date or outcome will be provided. The scope, fees, milestones and any service-specific conditions are those set out in a written proposal, order or agreement accepted by both parties.
Project scope and client responsibilities
The client must provide accurate information, content and permissions needed for the agreed work, designate a person who can give instructions, review deliverables and respond to requests in a reasonable time. The client is responsible for ensuring that materials and instructions it supplies may lawfully be used. Delays, new requirements or changes to approved scope may require a revised schedule and fee, which will be agreed in writing before the additional work proceeds.
Fees, payment and suspension
Fees, payment dates, taxes and any expenses are stated in the applicable written proposal or agreement. The client must pay invoices by the stated due dates. Boochy Tech may pause affected work or hosting after giving notice where an undisputed amount remains overdue, subject to the agreement and applicable law. Work completed and approved expenses remain payable as set out in the agreement. No general refund promise is made by this page; cancellation and any refund are governed by the written agreement and mandatory law.
Intellectual property and third-party materials
Unless a written agreement says otherwise, Boochy Tech retains ownership of its pre-existing tools, reusable components, methods and software products. Rights in custom deliverables are granted or transferred only as the applicable agreement states and after the client has paid amounts due for those deliverables. Third-party and open-source materials remain subject to their own licences. The client warrants that it has the rights needed for materials it supplies and will address claims arising from unlawful or infringing client materials.
Hosting, products and availability
Any hosting, maintenance, support or uptime commitment applies only if stated in the relevant written plan or agreement. We may perform maintenance or suspend access where reasonably necessary for security, legal compliance or service operation. Our software products may have separate product terms or licence conditions, which apply to their use. Trading involves risk; Boochy Forex Bot is a software tool, not financial advice, and no returns are guaranteed.
Disclaimers and liability
We provide services with reasonable care and skill. To the maximum extent permitted by Kenyan law, Boochy Tech is not liable for indirect or consequential loss, loss of anticipated profit, or loss caused by the client’s systems, instructions or third-party services outside our reasonable control. To the maximum extent permitted by law, Boochy Tech’s total liability for a claim is limited to the fees paid or payable under the applicable written agreement for the affected service. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
Suspension, termination and governing law
Either party may end an engagement as provided in its written agreement. On termination, the client remains responsible for fees and approved expenses due for work performed up to the effective termination date, subject to that agreement and applicable law. These terms are governed by the laws of Kenya, and disputes are subject to the jurisdiction of competent Kenyan courts.
